These Terms & Conditions (“Terms”) govern your use of cafeinacreative.com (the “Site”), operated by Ariana Montoya d/b/a Cafeina Creative (“Cafeina Creative,” “we,” “us,” or “our”), a creative studio based in West Palm Beach, Florida. By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

The Site describes the web design, photography, branding, and creative services we offer. That information is general and is not an offer to provide services. Availability, pricing, and timelines (including announcements such as booking dates) may change at any time. When you hire us, your project is governed by a separate written proposal or agreement, which controls if it conflicts with these Terms.
When you submit our Start a Project form, you confirm that the information is accurate and that you’re allowed to share it. Sending an inquiry doesn’t create a client relationship or obligate either of us to work together. Our Privacy Policy explains how we handle the information you send.
The Site and its content, including text, photography, graphics, designs, logos, and the Cafeina Creative name, are owned by Cafeina Creative or used with permission, and are protected by copyright and trademark law. Portfolio work is shown with our clients’ permission, and our clients’ names and marks belong to them. You’re welcome to view the Site and share links to it, but you may not copy, download, modify, or reuse its content, including images, without our written permission.
Any free guides, resource lists, or recommendations we share are for general information and personal use. They’re provided without guarantees, and we may change or remove them at any time. Some may point to third-party tools, which we don’t control.
The Site links to and displays content from third parties, such as Instagram and Substack. We don’t control those services and aren’t responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee that the Site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Cafeina Creative will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site. Our total liability for any claim related to the Site is limited to one hundred U.S. dollars (US$100). This section doesn’t limit anything in a separate agreement for services we provide to you.
You agree to defend and hold harmless Cafeina Creative from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.
We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they last changed. Continuing to use the Site after an update means you accept the revised Terms.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn’t a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the Site.
